How to avoid undue influence claims

When planning your will, you want to be sure that you plan it so you can avoid undue influence claims that could arise. Here are a few ways you can do that:

  • Include a revocable or living trust. These are harder to challenge.
  • Make sure that you establish competency. If you can show that you were in good mental and physical health when you created your will, then it is less likely that someone will challenge it on the grounds of undue influence.
  • Discuss your will with your family. Either in person, or in your will explain your reasoning for how you divide things up. There are no guarantees that it still won’t be challenged, but an explanation may help.
